The Minister may, in writing, approve a project as an AusLink Transport Development and Innovation Project if, and only if:

(a) the Minister is satisfied that the project is eligible for approval (see section 30); and
(b) the Minister considers that it is appropriate to approve the project (see section 31).

An instrument approving a project is not a legislative instrument for the purposes of the Legislative Instruments Act 2003 .
