ABORIGINAL COUNCILS AND ASSOCIATIONS ACT 1976 No. 186 of 1976 - SECT 46
Incorporation of Aboriginal association.
46. (1) Upon the issue to an Aboriginal association of a certificate of
incorporation under section 45, the association-
(a) becomes a body corporate with perpetual succession;
(b) shall have a common seal;
(c) may acquire, hold and dispose of property, other than an estate or
interest in land;
(d) may acquire and hold an estate or interest in land and may-
(i) in the case of a disposable estate or interest-mortgage, charge
or otherwise dispose of the estate or interest; or
(ii) in any other case-dispose of the estate or interest, with the
consent of the Minister, to another Aboriginal Corporation; and
(e) may sue and be sued in its corporate name.
(2) The name of an Incorporated Aboriginal Association is the name set out in
its certificate of incorporation.
(3) The common seal of an Incorporated Aboriginal Association is of no effect
unless the name of the Association is inscribed on the seal in legible
characters.
(4) All courts, judges and persons acting judicially shall take judicial
notice of the seal of an Incorporated Aboriginal Association affixed to a
document and shall presume that it was duly affixed.
