ABORIGINAL COUNCILS AND ASSOCIATIONS ACT 1976 No. 186 of 1976 - SECT 33

Alteration of functions.
33. (1) An Aboriginal Council may request the Registrar to alter the functions
of the Council in the manner specified in the request.

(2) Where the Registrar is satisfied, with respect to a request under
sub-section (1)-

   (a)  that a substantial majority of adult Aboriginals living in the area of
        the Aboriginal Council is in favour of the alteration specified in the
        request;

   (b)  that, having regard to the needs and resources of the Aboriginals
        living in that area, the Council could effectively perform the
        functions as proposed to be altered in accordance with the request;
        and

   (c)  that the functions as proposed to be altered in accordance with the
        request include at least 1 function in the nature of the provision of
        a service to the Aboriginals living in that area, the Registrar shall,
        by notice published in the Gazette, alter the functions of the Council
        in accordance with the request.

(3) An alteration of the functions of an Aboriginal Council under sub-section
(2) takes effect on the date of publication of the notice.

(4) Where the Registrar is not satisfied as required by sub-section (2) with
respect to a request under sub-section (1), he shall refuse the request and
shall notify the Aboriginal Council, in writing, accordingly.
