Persons cease to be members of Regional Councils in certain circumstances
122. (1) Where the Commission is satisfied that a member of a Regional
Council, since becoming, or last becoming, a member of the Regional Council:
(a) has been convicted of an offence against a Commonwealth, State or
Territory law and sentenced to imprisonment for one year or longer;
(b) has been convicted of an offence against a Commonwealth, State or
Territory law involving dishonesty and sentenced to imprisonment for 3
months or longer; or
(c) has failed, without reasonable excuse, to comply with section 119; the
Commission shall, in writing, declare that it is so satisfied.
(2) Where the Commission makes a declaration under subsection (1) about a
member of a Regional Council, the member ceases to be a member of the Regional
Council on the date of the declaration.
