WORKPLACE RELATIONS REGULATIONS 2006 - REG 2.9.11

         (1)   An employer must allow an authorised ballot agent access to:

                (a)    a workplace; or

               (b)    another place of business for the employer;

for the purpose of preparing for, or conducting, a ballot.

         (2)   Strict liability applies to the physical elements in subregulation (1).

Note    For strict liability , see section 6.1 of the Criminal Code .

         (3)   Subregulation (1) is a civil remedy provision.
