Commonwealth Consolidated Regulations Commonwealth Consolidated Regulations(1) Application for the closure of the registration of a registered ship, not being a ship that is required to be registered under the Act, may be made by lodging with the Registrar:
(a) an application in writing for the closure of the registration of the ship duly signed:
(i) in the case of a ship that belongs to one person only -- by that person; or
(ii) in the case of a ship that belongs to more than one person -- by a person appointed for the purpose by persons who are the owners of interests in the ship the sum of which is equal to not less than 33 shares in the property in the ship;
(b) where the application is signed by a person appointed for the purpose in pursuance of subparagraph (a) (ii), the document or documents constituting the appointment of that person; and
(c) the registration certificate or provisional registration certificate, as the case requires.
(2) The appointment of a person in pursuance of subparagraph (1) (a) (ii) for the purpose of signing an application referred to in subregulation (1) must be in writing and:
(a) must specify the ship to which it relates;
(b) must be duly signed by each person making the appointment; and
(c) where the appointment is made by more than one person, may consist of several documents in like form, each duly signed by one or more of those persons.
(3) An application under subregulation (1) must specify:
(a) the registered name of the ship;
(b) the official number of the ship; and
(c) the home port of the ship.
(4) Where the Registrar receives an application under subregulation (1) relating to a ship, the Registrar must make an entry in the Register to that effect, and the registration of the ship must be deemed to be closed.
