Commonwealth Consolidated Regulations(1) For the purposes of subsection 29 (4) of the Act, this regulation sets out procedures applicable to the termination of the engagement of a non‑ongoing APS employee.
(2) If an employment arrangement sets out procedures that apply to the termination of the non‑ongoing APS employee, the procedures apply to the termination of the engagement of the employee unless the procedures:
(a) are prohibited content (within the meaning given by the Workplace Relations Act 1996 ); or
(b) would be prohibited content of that kind if the employment arrangement were a workplace agreement.
(3) The engagement of a non‑ongoing APS employee may be terminated on the grounds of a breach of the Code of Conduct only in accordance with procedures established by an Agency Head under subsection 15 (3) of the Act.
Note The Workplace Relations Act 1996 has rules and entitlements that apply to termination of employment.
