NATIONAL LIBRARY REGULATIONS 1994 - REG 11
Removal of persons from Library property
- (1)
- An authorised person may direct a person, other than a member of staff of
the Library, to leave Library property, if there are reasonable grounds for
believing that the person is committing or has committed an offence against
these Regulations.
- (2)
- The person must obey the direction.
Penalty: 5 penalty
units.
- (2A)
- Strict liability applies to subregulation (2).
- (2B)
- It is a defence to a prosecution for an offence against
subregulation (2) if the person had a reasonable excuse.
Note
A defendant bears an evidential burden in relation to the
question whether he or she had a reasonable excuse (see section 13.3 of
the Criminal Code ).
- (3)
- If the person refuses to obey the direction, the authorised person may,
using such force as is reasonable and necessary, remove the person from
Library property.
