NAVAL ESTABLISHMENTS REGULATIONS - REG 101
Powers etc of members of Naval Police
- (1)
- For the purpose of ascertaining whether an offence is being or has been
committed or attempted at any naval establishment, a member of the Naval
Police may, without warrant, detain and search any person who is in a naval
establishment, or any bag, parcel, vehicle, or other receptacle which is in,
or is being conveyed into, or out of, a naval establishment, or any ship, boat
or aircraft in or alongside or in the vicinity of a naval establishment.
- (2)
- If a member of the Naval Police has reasonable ground to believe:
- (a)
- that any person has committed, or attempted to commit, any offence in a naval
establishment; and
- (b)
- that proceedings against the person by summons would
not be effective;
he may, without warrant, apprehend the person and deliver
him into the custody of the civil authorities to be dealt with according to
law.
- (3)
- For the purposes of this regulation, offence means an offence against the
common law, the Naval Defence Act 1910-1934 , the
Control of Naval Waters Act 1918 , the Crimes Act 1914-1932 or any other Act
relating to naval establishments or government property generally.
