MIGRATION REFORM (TRANSITIONAL PROVISIONS) REGULATIONS - REG 35

Section 172 of the amended Act applies to a non-citizen who was in Australia on 1 September 1994 as if, at the end of subsection (1), there were added the following word and paragraphs:

`; or (d) the person entered Australia lawfully before 1 September 1994 and has not left Australia; or

(e)

the person:

(i)

entered Australia unlawfully before 1 September 1994; and

(ii)

was subsequently granted an entry permit under the old Act and the Regulations as in force before that date; and

(iii)

has not left Australia after being granted that entry permit.'
