MIGRATION REFORM (TRANSITIONAL PROVISIONS) REGULATIONS - REG 19

Diplomats

(1)
A non-citizen who, immediately before 1 September 1994:

(a)
was in Australia; and

(b)
was an exempt non-citizen of the kind referred to in paragraph (b) of the definition of exempt non-citizen in subsection 4 (1) of the old Act;

is taken to have been granted a Subclass 995 (Diplomatic) visa on 1 September 1994.

(2)
The visa period of a Subclass 995 (Diplomatic) visa that is taken to have been granted to a non-citizen under subregulation (1) ends when the non-citizen ceases to have the status of a diplomatic or consular representative in Australia of a country other than Australia.

(3)
A non-citizen who:

(a)
was outside Australia immediately before 1 September 1994; and

(b)
held a Class 995 (Diplomatic) visa granted under the Migration (1993) Regulations or a diplomatic (code number 995) visa granted under the Migration (1989) Regulations;

is taken to have been granted a Subclass 995 (Diplomatic) visa on 1 September 1994 permitting him or her to travel to and enter Australia until the date specified by the Minister for that purpose in the visa referred to in paragraph (b), and to remain in Australia until the non-citizen, or the non-citizen of whose family unit he or she is a member, as the case requires, ceases to have the status of a diplomatic or consular representative in Australia of a country other than Australia.
