MIGRATION REFORM (TRANSITIONAL PROVISIONS) REGULATIONS - REG 15

Conditions of bridging visa under regulation 10, 12, 13 or 14

(1)
If a non-citizen was subject to a reporting condition immediately before 1 September 1994, a bridging visa taken to be granted to him or her under regulation 10, 12, 13 or 14 is subject to the same reporting conditions as those to which the non-citizen was subject before that date.

(2)
If, immediately before 1 September 1994, the non-citizen:

(a)
was an illegal entrant; and

(b)
had applied before that date for an entry permit of any of the following classes:

(i)
Class 817 (protection (permanent)) under the Migration (1993) Regulations; or
(ii)
Class 784 (domestic protection (temporary)) under the Migration (1993) Regulations; or
(iii)
domestic protection (temporary) (code number 784) under the Migration (1989) Regulations; and
(c)
had been given written permission to work under subsection 83 (2) of the old Act;

a bridging visa taken to have been granted to him or her under regulation 10, 12, 13 or 14 is subject to the conditions with regard to work that applied to the non-citizen immediately before 1 September 1994.

(3)
Subject to this regulation, the conditions of a bridging visa taken to be granted to a non-citizen under regulation 10, 12, 13 or 14 are the conditions set out in Schedule 2 of the Migration Regulations in relation to a bridging visa of that subclass.
