MIGRATION REFORM (TRANSITIONAL PROVISIONS) REGULATIONS - REG 12
Non-citizens outside Australia with applications not finally determined on 1 September 1994
- (1)
- This regulation applies to a non-citizen who:
- (a)
- was outside Australia
on 1 September 1994; and
- (b)
- immediately before that date, held a visa
permitting him or her to travel to, or to travel to and enter Australia; and
- (c)
- would be a non-citizen to whom regulation 10 or 13 applies if he or she
had been in Australia on 1 September 1994.
- (2)
- A non-citizen to whom this regulation applies is taken, on
1 September 1994, to have been granted a bridging visa Class B permitting
him or her:
- (a)
- to travel to and enter Australia during the period during which the visa
referred to in paragraph (1) (b) would have permitted him or her to do so; and
- (b)
- to remain in Australia until 28 days after his or her substantive visa
application is finally determined.
