Commonwealth Consolidated Regulations (1) On the filing of
an Application for Divorce, the Registry Manager must fix a date for the
hearing of the application.
(2) The date fixed
must be:
(a) for a joint
application — at least 28 days after the application is filed; or
(b) for any other
application:
(i) if the respondent
is in Australia — at least 42 days after the application is filed;
or
(ii) if the respondent
is outside Australia — at least 56 days after the application
is filed.
Note 1 An Application for Divorce (other than a joint
application) must be served on the respondent (see rule 7.03).
Note 2 When an Application for Divorce is served, the
respondent must also be given a brochure approved by the Principal Registrar
(see rule 2.03).
