FEDERAL COURT RULES - ORDER 1 RULE 4A

                Unless these Rules provide otherwise, the Court may exercise a power under these Rules in a proceeding:

                       (a)    on its own initiative; or

                      (b)    on the application of a party, or a person who has sufficient interest in the proceeding.
