ENVIRONMENT PROTECTION AND BIODIVERSITY CONSERVATION REGULATIONS 2000 - REG 8.09

Touching and sudden movements

         (1)   A person must not:

                (a)    touch a cetacean; or

               (b)    make sudden movements within 2 metres of a cetacean.

Penalty:   50 penalty units.

         (2)   An offence under subregulation (1) is an offence of strict liability.
