Commonwealth Consolidated Regulations(1) A person who has made an application to the Tribunal may, with the leave of the Tribunal, withdraw the application at any time before the Tribunal has determined the application.
(2) The leave of the Tribunal under the last preceding subregulation may be granted unconditionally or subject to such conditions as the Tribunal thinks reasonable.
(3) Where the Tribunal has granted leave for the withdrawal of an application, the withdrawal shall be effected by:
(a) the filing with the Secretary of a notice in writing:
(i) addressed to the Secretary;
(ii) specifying the date on which the application was made and the relevant file number;
(iii) stating that the person who made the application withdraws the application; and
(iv) signed by or on behalf of that person; and
(b) the serving of a sealed copy of the notice on every party to the application.
