CIVIL AVIATION SAFETY REGULATIONS 1998 - REG 42.995
Requirements to be met by continuing airworthiness management organisations before approving proposed variations(1) A continuing airworthiness management organisation must ensure that an individual does not approve a proposed variation to an approved maintenance program for an aircraft on its behalf unless the requirements mentioned in regulation 42.990 are met.
Offence for breach of obligation
(2) A continuing airworthiness management organisation commits an offence if:
(a) an individual approves a proposed variation to an approved maintenance program for an aircraft on its behalf; and
(b) a requirement mentioned in regulation 42.990 is not met in relation to the approval.
(3) An offence against subregulation (2) is an offence of
strict liability.
