CIVIL AVIATION SAFETY REGULATIONS 1998 - REG 129.105
Foreign air transport operations--flying in formation(1) The operator of an aircraft engaged in a flight that is a foreign air transport operation contravenes this subregulation if, during the flight:
(a) the aircraft is flown in formation; and
(b) the operator does not hold an approval under regulation 129.020 for the aircraft to be flown in formation during the flight.
(2) A person commits an offence of strict liability if the person contravenes subregulation (1).
