TELECOMMUNICATIONS ACT 1997 - SECT 96
Exemption from certain regulatory provisions--Ministerial determination(1) The Minister may, by legislative instrument, determine that a specified regulatory provision does not apply to a specified person in the person's capacity as a designated carriage service provider. For this purpose, a designated carriage service provider is a person who is a carriage service provider under subsection 87(4) or (5).
Note: For specification by class, see subsection 13(3) of the Legislation Act 2003 .
(2) A determination under this section may be unconditional or subject to such conditions (if any) as are specified in the determination.
(3) A determination under this section has effect accordingly.
(5) For the purposes of this section, a regulatory provision is a provision of:
(a) this Act; or
(b) any other law of the Commonwealth;
that contains a reference to a carriage service provider or to carriage
service providers.
