Note 1

The Seafarers Rehabilitation and Compensation Act 1992 as shown in this compilation comprises Act No. 234, 1992 amended as indicated in the Tables below.

The Seafarers Rehabilitation and Compensation Act 1992 was amended by the Workplace Relations Amendment (Work Choices) (Consequential Amendments) Regulations 2006 (No. 1) (SLI 2006 No. 50). The amendments are incorporated in this compilation.

All relevant information pertaining to application, saving or transitional provisions prior to 8 March 1997 is not included in this compilation. For subsequent information see Table A.

(a)     The Seafarers Rehabilitation and Compensation Act 1992 was amended by the Schedule (items 72-113) only of the Transport and Communications Legislation Amendment Act (No. 2) 1993, subsections 2(1) and (10) of which provide as follows:

                 (1)   Subject to subsections (2) to (10) (inclusive), this Act commences on the day on which it receives the Royal Assent.

               (10)   The amendments contained in items 111 and 112 of the Schedule are taken to have commenced on 24 June 1993.

(b)    The Transport and Communications Legislation Amendment Act (No. 2) 1993 was amended by Schedule 3 (item 123) only of the Statute Law Revision Act 1996, subsection 2(3) of which provides as follows:

                 (3)   Each item in Schedule 3 is taken to have commenced when the Act containing the provision amended by the item received the Royal Assent.

(c)     The Seafarers Rehabilitation and Compensation Act 1992 was amended by Schedule 19 (items 43, 44) only of the Workplace Relations and Other Legislation Amendment Act 1996, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

(d)     The Workplace Relations and Other Legislation Amendment Act 1996 was amended by Schedule 3 (items 1, 2) only of the workplace Relations and Other Legislation Amendment Act (No. 2) 1996, subsection 2(4) of which provides as follows:

                 (4)   The items of Schedule 3 are taken to have commenced immediately after the Workplace Relations and Other Legislation Amendment Act 1996 received the Royal Assent.

(e)     The Seafarers Rehabilitation and Compensation Act 1992 was amended by Schedule 1 only of the Marine Personnel Legislation Act 1997 subsections 2(1) and (2) of which provide as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

                 (2)   Item 75 of Schedule 1 is taken to have commenced on 24 June 1993, immediately after the commencement of section 93 of the Seafarers Rehabilitation and Compensation Act 1992.

(f)      The Seafarers Rehabilitation and Compensation Act 1992 was amended by Schedule 2 (item 72) only of the Assistance for Carers Legislation Amendment Act 1999, subsection 2(2) of which provides as follows:

                 (2)   The following provisions:

                              (a)   Parts 1 and 4 of Schedule 1;

                              (b)   Schedule 2 (other than items 1 and 3);

                              (c)   Schedule 3 (other than item 1);

commence immediately after the commencement of Schedule 1 to the Payment Processing Legislation Amendment (Social Security and Veterans' Entitlements) Act 1998.

Note:          Schedule 1 to the Payment Processing Legislation Amendment (Social Security and Veterans' Entitlements) Act 1998 commences on 1 July 1999.

(g)     The Seafarers Rehabilitation and Compensation Act 1992 was amended by Schedule 11 (item 5) only of the A New Tax System (Family Assistance) (Consequential and Related Measures) Act (No. 2) 1999, subsection 2(10)(a) of which provides as follows:

               (10)   Item 5 of Schedule 11 commences, or is taken to have commenced, immediately after the commencement of:

                              (a)   Schedule 1 to the A New Tax System (Family Assistance) (Consequential and Related Measures) Act (No. 1) 1999; or

         Schedule 1 commenced on 1 July 2000.

(h)     The Seafarers Rehabilitation and Compensation Act 1992 was amended by Schedule 1 (item 808) only of the Public Employment (Consequential and Transitional) Amendment Act 1999, subsections 2(1) and (2) of which provide as follows:

                 (1)   In this Act, commencing time means the time when the Public Service Act 1999 commences.

                 (2)   Subject to this section, this Act commences at the commencing time.

(i)      The Seafarers Rehabilitation and Compensation Act 1992 was amended by Schedule 1 (items 119-132) only of the Employment, Workplace Relations and Small Business Legislation Amendment (Application of Criminal Code) Act 2001, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day after the day on which it receives the Royal Assent.

(j)      Subsection 2(1) (item 2) of the Superannuation Legislation Amendment (Simplification) Act 2007 provides as follows:

                 (1)   Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1

42  Saving of existing notices

A notice duly given before the commencement of item 41 under subsection 67(1) of the Seafarers Rehabilitation and Compensation Act 1992 and in force immediately before that commencement continues in force as if it had been duly given under that subsection as amended by that item.

47  Transitional

Despite the repeals and substitutions effected by item 46, the repealed sections continue to apply in respect of claims made before the commencement of that item.

49  Application

The amendment made by item 48 applies only to decisions of the Authority given in respect of claims made after the commencement of that item.

53  Application

The amendment made by item 52 applies only to decisions of the Authority given in respect of claims made after the commencement of that item.

56  Transitional

Despite the repeal and substitution effected by item 55, the repealed section continues to apply in respect of a reconsideration requested before the commencement of that item.

58  Application

The amendment made by item 57 applies to decisions of the Authority given in respect of claims made after the commencement of that item.

92  Saving of existing notices

A notice duly given before the commencement of item 91 under subsection 126(1) of the Seafarers Rehabilitation and Compensation Act 1992 and in force immediately before that commencement continues in force as if it had been duly given under the subsection substituted by that item.

95  Transitional

Despite the repeal effected by item 94, the repealed section continues to apply in respect of an injury suffered by an employee, or in respect of loss of, or damage to, property used by an employee, if the injury, or the loss or damage, happened before the commencement of that item.

73  Application

The Seafarers Rehabilitation and Compensation Act 1992 has effect on and after 1 July 1999 as if a reference to carer allowance in paragraph 15(4)(b) of that Act included a reference to child disability allowance (within the meaning of the Social Security Act 1991).

4  Application of amendments

             (1)  Each amendment made by this Act applies to acts and omissions that take place after the amendment commences.

             (2)  For the purposes of this section, if an act or omission is alleged to have taken place between 2 dates, one before and one on or after the day on which a particular amendment commences, the act or omission is alleged to have taken place before the amendment commences.

406  Application

(1)        The amendments made by this Schedule apply to the 2007‑2008 income year and later years.

(2)        Despite subitem (1), those amendments apply to the 2007‑2008 financial year and later years, to the extent that they relate to Division 292 of the Income Tax Assessment Act 1997.

(3)        Despite subitem (1), those amendments apply on and after 1 July 2007, to the extent that they relate to any of the following:

                     (a)  Divisions 82 and 83 of the Income Tax Assessment Act 1997;

                     (b)  Divisions 301 to 307 of that Act.

39  Application of amendments of the Seafarers Rehabilitation and Compensation Act 1992

(1)        The amendments of the Seafarers Rehabilitation and Compensation Act 1992 made by this Schedule apply in relation to a payment made under that Act on or after the commencement of the amendments, other than a payment of a lump sum benefit to which subitem (2) applies.

(2)        The amendments of the Seafarers Rehabilitation and Compensation Act 1992 made by this Schedule apply in relation to a lump sum benefit payable in respect of the death of a person if the death occurs on or after the commencement of the amendments.

Schedule 1

12  Application--compensation for the benefit of dependants

(1)        The amendments made by items 8 and 9, to the extent that they relate to subsections 29(3) and (4) of the Seafarers Rehabilitation and Compensation Act 1992, apply in relation to the death of an employee that occurs on or after 1 July 2009.

(2)        The amendment made by item 10 applies in relation to the death of an employee that occurs at or after the commencement of this item.

13  Application--compensation for the benefit of children

(1)        The amendments made by items 8 and 9, to the extent that they relate to subsection 29(5) of the Seafarers Rehabilitation and Compensation Act 1992, apply in relation to a payment for a week that begins on or after 1 July 2009.

(2)        The amendment made by item 11 applies in relation to a payment for a week that begins at or after the commencement of this item.
