SEA INSTALLATIONS ACT 1987 - SECT 29

Permit not to be varied in certain circumstances

             (1)  The Minister shall not vary a permit in such a way that it would authorise the sea installation to which it relates to be installed in the adjacent area of a State, of the Northern Territory or of Norfolk Island unless the Minister has given a representative of the State or Territory an opportunity to discuss the variation with a representative of the Commonwealth.

             (2)  The Minister shall not vary a permit to operate a sea installation in the adjacent area of a State or Territory if the Minister considers that the variation would result in the installation, operation or use of the installation in accordance with the permit as varied being, either because of this Act or otherwise, contrary to another law of the Commonwealth or a law applying by virtue of section 46, 47 or 48.
