REFERENDUM (MACHINERY PROVISIONS) ACT 1984 - SECT 108
Immaterial errors not to invalidate referendum(1) A referendum or a return or statement showing the voting at a referendum shall not be declared void on account of:
(i) the taking of the votes of the electors; or
(ii) the making of any statement or return; or
(b) the absence of any officer or any error of, or omission by, an officer;
that did not affect the result of the referendum.
(2) Where any elector was, on account of the absence of any
officer, or error of, or omission by, any officer, prevented from voting at a
referendum, the High Court shall not, for the purpose of determining whether
the absence, error or omission did or did not affect the result of the
referendum, admit any evidence of the way in which the elector intended to
vote.
