PUBLIC ORDEU(PROTECTION OF PERSONS AND PROPERTY) ACT 1971 - SECT 7
Causing actual bodily harm or damage to property
- (1)
- A person who, in a Territory or on Commonwealth premises, while taking
part in an assembly, intentionally causes:
- (a)
- actual bodily harm to
another person; or
- (b)
- damage, to an extent exceeding $1,500, to property;
is guilty of an indictable offence, punishable on conviction by imprisonment,
in the case of causing actual bodily harm, for a term not exceeding five years
or, in the case of causing damage to property, for a term not exceeding three
years.
- (2)
- For the purposes of an offence against subsection (1),
absolute liability applies to such of the following physical elements of
circumstance as are relevant to the offence:
- (a)
- that the person is in a
Territory or on Commonwealth premises;
- (b)
- that the extent of the damage to
property exceeds $1,500.
