PUBLIC ORDEU(PROTECTION OF PERSONS AND PROPERTY) ACT 1971 - SECT 13C
Power of authorised officer to require information
- (1)
- Subject to any limitations and restrictions provided by the regulations,
if an authorised officer in relation to a court believes on reasonable grounds
that it is necessary in the interests of security to do so, the officer may
require a person who is on the court premises to tell the officer:
- (a)
- the
person's name; and
- (b)
- the address of the person's place of residence; and
- (c)
- the person's reason for being on the premises; and
- (d)
- evidence of the
person's identity.

- (2)
- A person of whom such a requirement is
made must not:
- (a)
- refuse or fail to comply with the requirement; or
- (b)
- give false information, or false evidence of identity, in response to the
requirement.
Penalty: 20 penalty units.
- (3)
- Subsection (2) does not
apply if the person has a reasonable excuse.
Note: A defendant bears an
evidential burden in relation to the matter in subsection (3) (see
subsection 13.3(3) of the Criminal Code ).
