PUBLIC EMPLOYMENT (CONSEQUENTIAL AND TRANSITIONAL) AMENDMENT ACT 1999 - SECT 13
References in statutory instruments to "officer" etc.
- (1)
- In any statutory instrument (other than the Acts Interpretation Act 1901
), unless the contrary intention appears:
- (a)
- references in general terms
to an officer include references to a new Act Secretary or an APS employee;
and
- (b)
- references to an officer of the Commonwealth include references to a
new Act Secretary or an APS employee; and
- (c)
- references to an officer or
employee of a particular Department or Statutory Agency include references to
an APS employee in that Department or Statutory Agency; and
- (d)
- references to
a person occupying, holding or performing the duties of an office in a
particular Department or Statutory Agency include references to an
APS employee in that Department or Statutory Agency; and
- (e)
- references to an
employee of a particular Department include references to a
locally engaged employee in that Department; and
- (f)
- references in general
terms to an office include references to a position occupied by an
APS employee; and
- (g)
- references to an office in a particular Department or
Statutory Agency include references to a position occupied by an APS employee
in that Department or Statutory Agency.
- (2)
- If a reference in a statutory instrument to "the Department" is read as a
reference to a particular Department because of subsection 19A(3) of the
Acts Interpretation Act 1901 , then that reference to "the Department" is a
reference to a particular Department for the purposes of this section.
