PLANT BREEDER'S RIGHTS ACT 1994 - SECT 83
Applications for plant variety rights lodged and criminal proceedings begun before commencing day(1) If, before the commencing day:
(a) a person has made application for plant variety rights under the old Act; but
(b) the application has not been finally disposed of under that Act;
the provisions of the old Act are taken to continue in force, for the purpose of dealing with the application, and any objection that has been made before that day, or is made after that day, in relation to the application.
(2) If before the commencing day, criminal proceedings had been
begun under the old Act but those proceedings had not been finally determined
before that day, the provisions of the old Act are taken to continue in force,
for the purposes of those proceedings.
