Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) Royalty under section 4, and an amount payable under subsection 9(2), are debts due to the Commonwealth by a person who is or has been a mining licence holder and are recoverable in a court of competent jurisdiction.
(2) Royalty and other amounts referred to in subsection (1) received by the Designated Authority shall be deemed to be received by the Designated Authority on behalf of the Commonwealth.
