Sale or supply of measuring instrument marked by someone not permitted to do so

Offence requiring fault element

  (1)   A person commits an offence if:

  (a)   the person sells or otherwise supplies a measuring instrument for use for trade, or uses a measuring instrument for trade; and

  (b)   the measuring instrument is marked with a verification mark; and

  (c)   the person who marked the measuring instrument with the verification mark was not permitted to do so.

Penalty:   200 penalty units.

Strict liability offence

  (2)   A person commits an offence if:

  (a)   the person sells or otherwise supplies a measuring instrument for use for trade, or uses a measuring instrument for trade; and

  (b)   the measuring instrument is marked with a verification mark; and

  (c)   the person who marked the measuring instrument with the verification mark was not permitted to do so.

Penalty:   40 penalty units.

  (3)   Subsection   (2) is an offence of strict liability.
