Relationship between System Operator and Data Governance Board in relation to data for research or public health purposes(1) In performing the function mentioned in paragraph 15(ma), the System Operator must comply with a direction from, and follow the guidance of, the Data Governance Board.
(2) If rules made for the purposes of subsection 109(7A) require the Data Governance Board to take steps to ensure that de - identified data and health information disclosed to persons for research or public health purposes is being used only for those purposes, the System Operator must not take any steps of its own to ensure that the data and information is being used only for those purposes.
(3) Subsection (2) does not imply that the
System Operator has a duty to take steps in relation to use of data and
information at a time when there are no rules of the kind mentioned in
subsection (2).
