(a)     The Lands Acquisition Act 1989 was amended by Schedule 1 (items 35 and 36) only of the Telecommunications (Transitional Provisions and Consequential Amendments) Act 1997, subsection 2(2)(d) of which provides as follows:

                 (2)   The following provisions commence on 1 July 1997:

                              (d)   Schedule 1;

(b)    The Lands Acquisition Act 1989 was amended by Schedule 2 (items 889-893) only of the Audit (Transitional and Miscellaneous) Amendment Act 1997 subsection 2(2)of which provides as follows:

                 (2)   Schedules 1, 2 and 4 commence on the same day as the Financial Management and Accountability Act 1997.

(c)     The Lands Acquisition Act 1989 was amended by Schedule 3 (items 46, 47) and Schedule 4 (items 67-71) only of the Environmental Reform (Consequential Provisions) Act 1999, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences when the Environment Protection and Biodiversity Conservation Act 1999 commences.

(d)     The Lands Acquisition Act 1989 was amended by Schedule 1 (item 555) only of the Public Employment (Consequential and Transitional) Amendment Act 1999, subsections 2(1) and (2) of which provide as follows:

                 (1)   In this Act, commencing time means the time when the Public Service Act 1999 commences.

                 (2)   Subject to this section, this Act commences at the commencing time.

Schedule 4

72  Transitional provision

The amendments of section 124 of the Lands Acquisition Act 1989 made by this Schedule do not affect the validity of any regulations made for the purposes of that section before the commencement of the amendments.

Schedule 9 

2  Compensation for acquisition of property

When compensation is necessary

(1)        If, apart from this item, the operation of this Act would result in an acquisition of property from a person that would be invalid because of paragraph 51(xxxi) of the Constitution (which deals with acquisition of property on just terms) the Commonwealth must pay the person a reasonable amount of compensation.

Definition

(2)        In this item:

acquisition of property has the same meaning as in paragraph 51(xxxi) of the Constitution.

Court can decide amount of compensation

(3)        If the Commonwealth and the person do not agree on the amount of compensation to be paid, the person may apply to the Federal Court of Australia for the recovery from the Commonwealth of a reasonable amount of compensation fixed by the Court.

Other compensation to be taken into account

(4)        In assessing compensation payable by the Commonwealth, the Court must take into account any other compensation or remedy arising out of the same event or situation.

4  Saving of matters in Part 2 of Schedule 1

             (1)  If:

                     (a)  a decision or action is taken or another thing is made, given or done; and

                     (b)  the thing is taken, made, given or done under a provision of a Part 2 Act that had effect immediately before the commencement of this Act;

then the thing has the corresponding effect, for the purposes of the Part 2 Act as amended by this Act, as if it had been taken, made, given or done under the Part 2 Act as so amended.

             (2)  In this section:

Part 2 Act means an Act that is amended by an item in Part 2 of Schedule 1.

Schedule 1

496  Saving provision--Finance Minister's determinations

If a determination under subsection 20(1) of the Financial Management and Accountability Act 1997 is in force immediately before the commencement of this item, the determination continues in force as if it were made under subsection 20(1) of that Act as amended by this Act.

Schedule 2

48  Application

(1)        The amendments made by items 1 to 18 apply to an acquisition by compulsory process of an interest in land, if the acquisition is made after the commencement of those items.

(2)        The amendments made by items 19 to 46 apply to a loss to which Division 1 of Part VIII of the Lands Acquisition Act 1989 applies, if the loss is suffered after the commencement of those items.

5  Application

The amendments made by items 3 and 4 apply to an acquisition by agreement of an interest in land if the acquisition is made after the commencement of those items.
