INTERNATIONAL TRANSFER OF PRISONERS ACT 1997 - SECT 20
Governmental consent to transfer from Australia
- (1)
- The Attorney-General is to notify the prisoner (or the prisoner's
representative) and any State or Territory Minister or Ministers whose consent
to the transfer is required under this Act:
(a) of the transfer country's
decision; and
(b) if consent is given, of the proposed method by which the sentence of
imprisonment will be enforced by the transfer country and any other
proposed terms of transfer.
- (2)
- The prisoner or prisoner's
representative and Minister concerned are to advise the
Attorney-General as to whether they consent to the transfer on the
terms proposed by the transfer country.
- (3)
- The Attorney-General is
to determine whether or not consent should be given to the transfer of
a prisoner on the terms proposed by the transfer country and is to
notify the transfer country as to whether consent has been given to
transfer of the prisoner on those terms or, if consent will be given
if the transfer country agrees to variation of the terms, of the
variation proposed.
