INTERNATIONAL TRANSFER OF PRISONERS ACT 1997 - SECT 18
Formal request for transfer
- (1)
- The Attorney-General may make a formal request in writing for transfer of
a prisoner from Australia to a transfer country.
- (2)
- In deciding whether to
make a formal request, the Attorney-General may take into account any matter
the Attorney-General considers relevant, including any matter advised by a
State or Territory Minister.
- (3)
- The Attorney-General is not to make a formal
request for transfer of a prisoner to a transfer country unless the
Attorney-General is satisfied that the transfer will (if the consents referred
to in subsection 20(2) are given) be able to be made in compliance with
section 10.
