INDUSTRIAL RELATIONS (CONSEQUENTIAL PROVISIONS) ACT 1988 - SECT 95
Court may resolve difficulties
- (1)
- Where any difficulty arises in:
- (a)
- the application of this Act in
relation to a particular matter; or
- (b)
- the application, in relation to a
particular matter, of a provision of the Industrial Relations Act because of
the operation of this Act;
the Court may, on the application of an
interested person, make such order as it considers proper to resolve the
difficulty.
- (2)
- An order made under subsection (1) has effect in spite
of anything contained in this Act, in the Industrial Relations Act 1988 or in
any Act in force immediately before the commencement.
- (3)
- The Court has
jurisdiction with respect to matters arising under this Act in relation to
which applications may be made to it under subsection (1).
