INDUSTRIAL RELATIONS (CONSEQUENTIAL PROVISIONS) ACT 1988 - SECT 40

(1)

A common rule in force under the previous Act immediately before the commencement remains in force after the commencement as if it had been declared under section 141 of the Industrial Relations Act, and section 142 of the Industrial Relations Act applies in relation to the common rule accordingly.

(2)

A hearing started under section 49 or 70K of the previous Act, but not completed before the commencement, shall be continued and completed by the Commission after the commencement, and section 141 of the Industrial Relations Act applies for the purposes of the continuation and completion of the hearing.

(3)

A hearing started under section 49A of the previous Act (including that section as it had effect under subsection 70K(3) of the previous Act), but not completed before the commencement, shall be continued and completed by the Commission after the commencement, and section 142 of the Industrial Relations Act applies for the purposes of the continuation and completion of the hearing.
