INDUSTRIAL RELATIONS (CONSEQUENTIAL PROVISIONS) ACT 1988 - SECT 14
Industrial disputes notified under previous Act
- (1)
- Where:
- (a)
- before the commencement, an industrial dispute was notified
under section 25 of the previous Act, or the relevant Presidential Member
under that Act otherwise became aware of an industrial dispute as mentioned in
subsection 25(3) of that Act; and
- (b)
- immediately before the commencement,
the industrial dispute had not been finally dealt with under that Act;
the
industrial dispute shall, after the commencement, be dealt with, as provided
by section 11 of this Act, in accordance with subsection (2) of this
section.
- (2)
- The industrial dispute shall be dealt with under the
Industrial Relations Act as if:
- (a)
- it had been notified under
section 99 of that Act or the relevant Presidential Member had otherwise
become aware of it as mentioned in section 100 of that Act;
- (b)
- any
reference of the industrial dispute under subsection 25(4) of the previous Act
had been done under subsection 100(1) of the Industrial Relations Act;
- (c)
- any findings made under section 24 of the previous Act in relation to the
industrial dispute had been made under section 101 of the Industrial
Relations Act; and
- (d)
- any conciliation proceeding, conference or arbitration
proceeding that took place under the previous Act had taken place under the
Industrial Relations Act.
