Commonwealth Consolidated Acts(1) The Secretary may cause to be issued to each authorised officer an identity card.
(2) An identity card must:
(a) be in a form approved in writing by the Secretary; and
(b) incorporate a recent photograph of the person.
(3) A person who ceases to be an authorised officer must, as soon as practicable after so ceasing, return his or her identity card to the Secretary.
(4) A person who fails to return his or her identity card, as provided for in subsection (3), is guilty of an offence punishable, on conviction, by a fine not exceeding $100.
(5) Subsection (4) does not apply if the person has a reasonable excuse.
Note: The defendant bears an evidential burden in relation to the matter in subsection (5). See subsection 13.3(3) of the Criminal Code .
(6) An offence under subsection (4) is an offence of strict liability.
