HIGH COURT OF AUSTRALIA ACT 1979 - SECT 8
Seniority The Justices other than the Chief Justice have seniority
according to the dates of their commissions or, where the commissions of two
or more Justices bear the same date, according to the precedence assigned to
them by their commissions.
