HEALTH AND OTHER SERVICES (COMPENSATION) ACT 1995 - SECT 19

Reconsideration of decisions about extensions of the period for giving statements

             (1)  If the claimant is dissatisfied with the Medicare Australia CEO’s decision about extension of the period, the claimant may apply in writing to the Medicare Australia CEO for the decision to be reconsidered.

             (2)  The application must be made within 28 days after the claimant is informed of the decision.

             (3)  Subject to section 20, within 28 days after receiving the application, the Medicare Australia CEO must:

                     (a)  reconsider the decision; and

                     (b)  if the decision under reconsideration was a refusal to extend the period—affirm the decision or substitute a decision granting an extension; and

                     (c)  if the decision under reconsideration was a decision granting an extension—affirm the decision or vary the decision by granting a longer period; and

                     (d)  give to the claimant a notice stating the Medicare Australia CEO’s decision on the reconsideration together with a statement of his or her reasons for the decision on the reconsideration.

             (4)  The Medicare Australia CEO’s decision on reconsideration of the decision has effect as if it had been made under subsection 18(3).
