GREAT BARRIER REEF MARINE PARK ACT 1975 - SECT 38E

Contravening directions--zoned area

                   A person must not intentionally or negligently contravene a direction given to the person by the Authority under the regulations, being a direction:

                     (a)  that is declared by the regulations to be a direction to which this section applies;

                     (b)  that is in respect of the person's use of, or entry to, a zone;

                     (c)  that is reasonably necessary for the protection or preservation of the Marine Park or property or things in the Marine Park; and

                     (d)  that does not require the person to remove a structure, landing area, farming facility, vessel, aircraft or other thing that is in the Marine Park.

Penalty:  200 penalty units.

Note:          If a body corporate is convicted of an offence, subsection 4B(3) of the Crimes Act 1914 allows a court to impose a fine of an amount that is not greater than 5 times the maximum fine that could be imposed by a court on an individual convicted of the same offence.
