Commonwealth Consolidated Acts(1) A person must not intentionally or negligently use or enter a zone for a purpose other than a purpose that is permitted under the zoning plan that relates to the zone.
Penalty: 200 penalty units.
Note: If a body corporate is convicted of an offence, subsection 4B(3) of the Crimes Act 1914 allows a court to impose a fine of an amount that is not greater than 5 times the maximum fine that could be imposed by a court on an individual convicted of the same offence.
(2) A person is guilty of an offence if the person uses or enters a zone for a purpose other than a purpose that is permitted under the zoning plan that relates to the zone.
Penalty: 60 penalty units.
(3) An offence under subsection (2) is an offence of strict liability.
