FREEDOM OF INFORMATION ACT 1982 - SECT 53

Interpretation

                   For the purposes of this Part, unless the contrary intention appears:

                     (a)  a certificate given under subsection 33(4), 33A(4), 34(4) or 35(4) in respect of a document as described in a request shall be deemed to be a certificate given in respect of the document so described notwithstanding that the certificate does not acknowledge the existence or non‑existence of the document so described; and

                     (b)  a claim that a document would, if it exists, be an exempt document under section 33, 33A, 34 or 35 shall be deemed to be a claim that the document is an exempt document under that section notwithstanding that the existence or non‑existence of the document is not acknowledged.
