EXPORT MARKET DEVELOPMENT GRANTS ACT 1997 - SECT 18

             (1)  Subject to subsections (2) and (3), this Division applies to a person (other than an approved body, approved joint venture or approved trading house) that applies for a grant in respect of a grant year unless:

                     (a)  the person is a grantee in respect of any previous grant year; or

                     (b)  the person's application for a grant in respect of the immediately preceding grant year is pending.

Note:          For person and grantee see section 107.

             (2)  If the person applies for a grant in the capacity of trustee of a trust estate, then, for the purposes of subsection (1), disregard:

                     (a)  any grant previously paid or payable to the person; and

                     (b)  any application for a grant made by the person;

otherwise than in that capacity.

             (3)  If the person applies for a grant in the person's own right, then, for the purposes of subsection (1), disregard:

                     (a)  any grant previously paid or payable to the person; and

                     (b)  any application for a grant made by the person;

in the capacity of trustee of a trust estate.
