EVIDENCE AND PROCEDURE (NEW ZEALAND) ACT 1994 - SECT 38

Application of this Part

             (1)  This Part applies to all proceedings in a court in Australia, including such proceedings that:

                     (a)  relate to bail; or

                     (b)  are interlocutory proceedings or proceedings of a similar kind; or

                     (c)  are heard in chambers; or

                     (d)  relate to sentencing.

             (2)  In this section:

"court" means:

                     (a)  a federal court; or

                     (b)  a court of a State of Territory; or

                     (c)  a person or body authorised by:

                              (i)  a law of the Commonwealth, a State or Territory; or

                             (ii)  consent of parties; to hear, receive or examine evidence.
