EXTRADITION ACT 1988 - SECT 51

(1)

The jurisdiction of the Supreme Court of a State or Territory in matters arising under section 21 or 35 may be exercised by the Court constituted by a single Judge.

(2)

A matter arising under an extradition treaty shall, for the purposes of section 38 of the Judiciary Act 1903 , be deemed not to be a matter arising directly under a treaty.
