EXTRADITION ACT 1988 - SECT 33

Where:

(a)

a person has been remanded after being arrested under a provisional arrest warrant;

(b)

an indorsed New Zealand warrant has not been obtained in relation to the person; and

(c)

a magistrate is satisfied that there has been reasonable time for such a warrant to be obtained;

the magistrate shall:

(d)

if the person is held in custody—order that the person be released; or

(e)

if the person has been granted bail—order the discharge of the recognizances on which bail was granted.
