Commonwealth Consolidated Acts(1) An employer must not, for a prohibited reason, or for reasons that include a prohibited reason, do or threaten to do any of the following:
(a) change the terms and conditions of employment of an employee to his or her prejudice;
(b) discriminate against an employee in his or her terms and conditions of employment;
(c) dismiss an employee.
(2) Conduct mentioned in subsection (1) is for a prohibited reason if it is engaged in because the employee:
(a) may volunteer to render defence service; or
(b) is rendering defence service; or
(c) is, or may become, liable to render defence service; or
(d) has previously rendered defence service.
(3) A person who contravenes subsection (1) is guilty of an offence.
Maximum penalty: 30 penalty units.
