DEFENCE FORCES RETIREMENT BENEFITS (PENSION INCREASES) ACT 1971 - SECT 4

(1)

This section applies to an eligible pensioner to whom pension is payable by virtue of section 73 of the Defence Forces Retirement Benefits Act 1948-1971 .

For the purposes of this section, the Defence Forces Retirement Benefits Act 1948-1971 shall be deemed to have effect as if the references in subsection (2) of section 73 of that Act to "One thousand one hundred and five dollars" and " Five hundred and fifty-two dollars fifty cents" were references to "One thousand three hundred and sixty-five dollars" and "Six hundred and eighty-two dollars fifty cents", respectively.

Where the pension payable to an eligible pensioner to whom this section applies would, if the pension were payable to him in accordance with the Defence Forces Retirement Benefits Act 1948-1971 as that Act is to be deemed to have effect for the purposes of this section, be payable at a rate higher than the rate at which, but for this section, the pension would be payable, he is entitled to an increase in the rate of the pension to that higher rate.
