(a)     The Defence Force Retirement and Death Benefits Act 1973 was amended by sections
156-163 only of the Defence Force Re‑organization Act 1975, section 2 of which provides as follows:

                   2.   This Part shall come into operation on the day on which this Act receives the Royal Assent, and the remaining provisions of this Act shall come into operation on such date as is, or such respective dates as are, fixed by Proclamation.

(b)    The Defence Force Retirement and Death Benefits Act 1973 was amended by section 116 only of the Statute Law Revision Act 1981, subsection 2(2) of which provides as follows:

                 (2)   Parts III, X and XV and section 116 shall come into operation on a date to be fixed by Proclamation.

(c)     The Defence Legislation Amendment Act 1984 was amended by section 3 only of the Statute Law (Miscellaneous Provisions) Act (No. 1) 1985, subsection 2(18) of which provides as follows:

               (18)   The amendment of Schedule 2 to the Defence Legislation Amendment Act 1984 made by this Act shall be deemed to have come into operation immediately before the commencement of section 89 of that Act.

         Section 89 commenced on 1 July 1983.

(d)     The Defence Force Retirement and Death Benefits Act 1973 was amended by subsection 4(1) only of the Defence Legislation Amendment Act 1990, subsection 2(4) of which provides as follows:

                 (4)   Subsection 4(1) is to be taken to have commenced on 30 June 1989.

(e)     The Defence Force Superannuation Legislation Amendment Act 1991 was amended by Schedule 3 (item 19) only of the Statute Law Revision Act 1996, subsection 2(3) of which provides as follows:

                 (3)   Each item in Schedule 3 is taken to have commenced when the Act containing the provision amended by the item received the Royal Assent.

(f)      The Defence Force Retirement and Death Benefits Act 1973 was amended by section 29 and the Schedule (Parts 3 and 6) only of the Qantas Sale Act 1992, subsections 2(2), (3)(b), (5) and (6) of which provide as follows:

                 (2)   Subject to subsection (3), the remaining provisions of this Act commence on a day or days to be fixed by Proclamation.

                 (3)   A Proclamation may fix a day that is earlier than the day on which the Proclamation is published in the Gazette but only if:

                              (b)   in the case of sections 22, 23, 26, 27, 29, 32, 33, 34, 42, 45, 46, 47, 48 and 49 and Parts 3 and 4 of the Schedule--the day is not earlier than the 50% sale day; and

                 (5)   If, on the 100% sale day, Part 3 of the Schedule has not commenced, then, on the day on which Part 7 of the Schedule commences, Parts 3 and 6 of the Schedule are taken to have been repealed.

                 (6)   If a provision of this Act has not commenced before 31 August 1995, the provision is taken to have been repealed on that day.

         The Schedule (Parts 3 and 6) is taken to have been repealed on 31 August 1995.

(g)     The Qantas Sale Act 1992 was amended by section 3 (item 17) only of the Qantas Sale Amendment Act 1994, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

(h)     The Defence Force Retirement and Death Benefits Act 1973 was amended by Schedule 6 only of the Superannuation Legislation Amendment (Superannuation Contributions Tax) Act 1997, subsection 2(1) of which provides as follows:

                 (1)   Subject to subsection (2), this Act commences on the day on which it receives the Royal Assent.

(i)      The Defence Force Retirement and Death Benefits Act 1973 was amended by Schedule 1 (item 43) only of the Financial Sector Reform (Consequential Amendments) Act 1998, subsection 2(2) of which provides as follows:

                 (2)   Subject to subsections (3) to (14), Schedules 1, 2 and 3 commence on the commencement of the Australian Prudential Regulation Authority Act 1998.

(j)      The Defence Force Retirement and Death Benefits Act 1973 was amended by Schedule 7 (items 28, 29) only of the Financial Sector Reform (Amendments and Transitional Provisions) Act (No. 1) 1999, subsections 3(2)(e) and (16) of which provide as follows:

                 (2)   The following provisions commence on the transfer date:

                      (e)   subject to subsection (12), Schedule 7, other than items 43, 44, 118, 205 and 207 (the commencement of those items is covered by subsections (10), (11) and (13)).

               (16)   The Governor‑General may, by Proclamation published in the Gazette, specify the date that is to be the transfer date for the purposes of this Act.

(k)     The Defence Force Retirement and Death Benefits Act 1973 was amended by Schedule 1 (items 370) only of the Public Employment (Consequential and Transitional) Amendment Act 1999, subsections 2(1) and (2) of which provide as follows:

                 (1)   In this Act, commencing time means the time when the Public Service Act 1999 commences.

                 (2)   Subject to this section, this Act commences at the commencing time.

(l)      The Defence Force Retirement and Death Benefits Act 1973 was amended by Schedule 2 (items 44-48) only of the Defence Legislation Amendment (Enhancement of the Reserves and Modernisation) Act 2001, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the 28th day after the day on which it receives the Royal Assent.

94  Saving--old regulations

(1)        Regulations that were in effect under any Act immediately before the commencement of this item continue to have effect after that time as if members of an arm of the Defence Force who were members of a particular part or component of that arm immediately before the commencement of this item were still members of that part or component after that time, even if that part or component no longer exists.

Example: Assume that, immediately before the commencement of this item, regulations imposed training obligations on members of the Air Force Specialist Reserve. Those obligations would continue to apply to former members of that Reserve after commencement, even though the Air Force Specialist Reserve itself is no longer mentioned in the Air Force Act 1923 and the members have now become members of the Air Force Reserve.

(2)        However, regulations that continue in effect under this item do so only to the extent that they are not amended or revoked by later regulations.

95  Regulations about transitional matters

(1)        The regulations may make provision in relation to other saving and transitional matters in connection with the amendments made by this Schedule.

(2)        In particular, such regulations may deal with the status, after the commencement of the amendments, of persons who were members of the Defence Force immediately before that time.

(3)        Subitem (2) does not limit the scope of subitem (1).

4  Application of amendments

             (1)  Each amendment made by this Act applies to acts and omissions that take place after the amendment commences.

             (2)  For the purposes of this section, if an act or omission is alleged to have taken place between 2 dates, one before and one on or after the day on which a particular amendment commences, the act or omission is alleged to have taken place before the amendment commences.

31  Application

(1)        The amendments and repeals made by this Schedule apply:

                     (a)  for the purpose of working out an increase in the rate of a pension benefit that is payable immediately before:

                              (i)  the prescribed half‑year beginning on 1 January 2002; and

                             (ii)  each subsequent prescribed half‑year; and

                     (b)  for any other purpose related to the purpose mentioned in paragraph (a).

(2)        To avoid doubt, the amendments and repeals made by this Schedule do not affect any increase in the rate of a pension benefit that arose from the operation of any provision amended or repealed by this Schedule.

4  Application of family law interest‑splitting amendments

             (1)  The family law interest‑splitting amendments apply to:

                     (a)  any splitting agreement, or splitting order, that has an operative time after the commencement of Schedule 1; and

                     (b)  a splitting agreement, or splitting order, with an earlier operative time, if no benefits had become payable before the commencement of Schedule 1 in respect of the superannuation interest to which the agreement or order relates.

             (2)  In this section:

family law interest‑splitting amendments means the amendments made by Schedule 1, other than items 24 and 34.

8  Application

(1)        The amendments made by this Schedule apply in respect of any application for restoration of a pension, or for restoration of the full rate of a pension, that is made on or after the day on which this Schedule commences.

(2)        If an application made before 1 January 2008 is granted, the pension is payable at the full rate only from 1 January 2008 (despite the following provisions:

                     (a)  subsection 44(3) of the Defence Force Retirement and Death Benefits Act 1973 (as inserted by item 1 of this Schedule);

                     (b)  subsection 64A(3) of the Defence Forces Retirement Benefits Act 1948 (as inserted by item 6 of this Schedule);

                     (c)  subsection 48AA(3) of the Superannuation Act 1922 (as inserted by item 7 of this Schedule)).

4  Application

The amendments made by this Part apply in respect of any spouse who survives a deceased person if the death of the deceased person occurs after this Part commences.

6  Application

The amendment made by this Part applies in relation to a later pension, or a lump sum amount, that is paid as a result of a period of effective service that begins on or after the day on which this Part commences.

24  Application of amendments of the Defence Force Retirement and Death Benefits Act 1973

The amendments of the Defence Force Retirement and Death Benefits Act 1973 made by this Schedule apply in relation to a benefit payable under that Act in respect of a person who dies on or after the commencement of this Schedule, if, at the time of his or her death, the deceased person was:

                     (a)  a contributing member (within the meaning of that Act); or

                     (b)  a recipient member (within the meaning of that Act); or

                     (c)  a person in respect of whom deferred benefits were applicable under section 78 of that Act.
