Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) A person who is a defence member or a defence civilian is guilty of an offence if:
(a) the person assaults another person; and
(b) that other person is a member of the Defence Force or of an allied force; and
(c) that other person is on guard duty.
Maximum punishment: Imprisonment for 2 years.
(2) A person who is a defence member or a defence civilian is guilty of an offence if:
(a) the person is engaged on service in connection with operations against the enemy; and
(b) the person assaults another person; and
(c) that other person is a member of the Defence Force or of an allied force; and
(d) that other person is on guard duty.
Maximum punishment: Imprisonment for 5 years.
